_STEP AUSTRALIA - NSW __Branch _invites you to an address by
Professor Prue Vines and Barrister, Mr. Simon Chapple, who will
present on “Testamentary Freedom and Aboriginal Estates”.
Professor Prue Vines will cover:
* ‘Indigenous people’s issues with succession law’:
Indigenous people’s needs may differ from those of non-Indigenous
clients
* The impact of common law on Indigenous people has been profound
and destructive and there has been very little attention paid to it by
succession lawyers until very recently.
* A burgeoning Indigenous middle class means there are significant
numbers of professionals and people likely to want to make wills.
Indigenous people who live in non-traditional ways do not give up
their ideas about family and often continue to maintain customary law
obligations.
* Who is regarded as part of the family may differ because kinship
structures differ
* More than 300 nations across Australia means their customary law
and patterns of kinship differ by nation
* Drafting wills for Indigenous people requires some changes to
normal drafting patterns. This will be discussed in detail in the
paper
* Appointments of Executor may be even more significant than for
non-Indigenous clients because of the importance of dealing with the
body.
Mr. Simon Chapple will cover:
* What happens when an Indigenous person dies intestate in NSW, and
the ways in which it is possible for the court to take account of
customary law in distributing the estate, and the consequences of
this. Recent cases will be addressed.
Nadine Miles, Principal Legal Officer at ALS NSW/ACT will provide some
brief comments at the conclusion of the seminar.
