Résumé
Qu’il s’agisse de l’histoire des significations sédimentées
des mots, constitutive de la langue comme « encyclopédie » (Eco),
du scénario légal à mettre en relation avec le script des faits du
dossier (Jackson), du traitement du cas à partir du jugement
réfléchissant, de la faculté imaginative et des récits exemplaires
(Kant, Arendt, Ferrara), de l’interprétation comme écriture d’un
roman à la chaîne et des juges comme conteurs moraux de la nation
(Dworkin)…, les rapports entre la narration et l’interprétation
sont multiples et déterminants.
Il y a le récit des mots, constitutif de l’interprétation des
textes, le récit des faits, constitutif de la singularité du cas, le
récit de l’historique des interprétations précédentes,
constitutif de l’ordre juridique entier, et enfin le récit du
jugement que je rends, ici et aujourd’hui, sous ma responsabilité
et qui est la combinaison de ces trois autres récits.
En un mot : interpréter, c’est moins déduire un sens à partir
d’un texte et d’un dictionnaire, que reconstruire un sens
crédible (mais aussi opportun, souhaitable) à partir d’un ensemble
virtuellement infini d’éléments qui se cherchent une cohérence à
travers la trame des différents récits que tissent les juges.
