TRAINER: Linda J. Garrett, JD - Linda Garrett has been providing risk management services to healthcare facilities and providers for over 25 years. As the loss prevention consultant for the CSAC Excess Insurance Authority Medical Malpractice Programs, she provides services to over 50 California public entity health, mental health, and correctional healthcare programs, as well as to several county hospitals in California, and Nevada rural hospitals. She trains providers and administrative staff on a variety of medical/legal topics including consent, charting, mandated reporting, involuntary mental health treatment, patients’ rights, and federal and state medical confidentiality laws (including HIPAA/HITECH Act, and 42 CFR Part 2). Before working as a risk manager, Ms. Garrett practiced as a medical malpractice defense attorney for a law firm in San Francisco, California. She is a graduate of the University of California, Berkeley and UC Hastings College of the Law.

Training Description

This will be a six-hour power-point presentation, with time for questions and discussion during and following each topic. Topics will include a review of new legislation affecting healthcare providers and their patients including new rules affecting licensure and training, minor consent, mandated reporters, drug prescribing and involuntary treatment. Also, information will be provided on the new 42 CFR Part 2 substance use disorder confidentiality regulations that became effective in 2017, as well as currently proposed changes. We will also review HIPAA and State law privacy and confidentiality issues, and multi-disciplinary teams. Finally we will review "hot topics" in the news and how individual free speech may trigger ethical concerns related to dual relationships and boundary issues.

Learning Objectives

Upon completion of the course, attendees will be able to:

• Describe the expansion of minor consent laws to include treatment for injuries caused by intimate partner violence;

• Articulate two ways that state law has changed to address involuntary hold processes;

• State two ways that the rules for dealing with the release of SUD information have changed under the 2017 regulations;

• Provide three examples of social media participation that could create "dual relationship" or "boundary issues" with a client.

CE CREDITS

This Course meets the qualifications for 6-hours of CE Credit for LMFTs, LCSWs, LPCCs, and/or LEPs; as required by the California Board of Behavioral Sciences. However, you must attend the entire training to qualify for CE Credit. Certificates will be issued within 30-days. The City of Berkeley is approved by California Association of Marriage and Family Therapists to sponsor continuing education for MFTs and LCSWs; the provider number is 140938.
