FUTURE HIGH SCHOOL STARS BASEBALL CAMP IN ATLANTA, GA MIDDLE SCHOOL ATHLETES -- GET SEEN EARLY AND LEARN FROM COLLEGE COACHES Coaches from the following collegiate programs are scheduled to appear: Covenant College, Reinhardt University, Point University, Andrew College Stars of Honor camps are designed for the next generation of stars seeking instruction from top collegiate coaches. These events provide an opportunity for players to be seen, coached and evaluated by coaches at the collegiate level. Through a combination of technical instruction, measurements and evaluations, and skill work in different key areas, Stars of Honor camp attendees will have an opportunity to improve their understanding of the game and showcase their abilities. Stars of Honor camps also provide a unique opportunity to gain insights on the steps to take today to advance towards an opportunity to play at the college level. Stars of Honor camp attendees will receive personalized feedback from the camp instructors. Stars of Honor camps are open to any and all, and we are here to help you on your journey to becoming a star at the next level. Campers should plan for active skill work, instruction, and information throughout the event. We encourage campers to solicit specific feedback and advice from coaches during the camp, and we also encourage parents to have conversations with coaches after the camp to get valuable feedback as well. Please come prepared to compete and learn. Among other things, players will: Participate in sessions designed specifically to showcase ability and compete Receive personalized instruction from highly qualified coaches at the camp Have opportunities to directly interact with coaches, ask questions, and receive tailored feedback Have the opportunity to be tested and evaluated on key metrics and measurables Learn valuable information about the recruiting process and how to position themselves to be recruited in the future Stars of Honor camps traditionally include three unique 2.5 hour sessions arranged by area of concentration. Q&A with the coaches will occur between each session. COVID-19 Policy The novel coronavirus, Coronavirus/COVID-19, has been declared a worldwide pandemic by the World Health Organization. Coronavirus/COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. Federal authorities and the State of Florida recommend social distancing to prevent the spread of Coronavirus/COVID-19. Contracting Coronavirus/COVID-19 can lead to severe illness, personal injury, permanent disability, and death. Stars of Honor has implemented the policies, protocols and preventative measures listed below in an attempt to reduce the spread of Coronavirus/COVID-19; however as with any facility, Stars of Honor cannot guarantee that you or your minor child(ren) will be 100% safe from airborne illnesses such as Coronavirus/COVID-19 or colds and flu while using the camp facilities or participating in camps/programs hosted or sponsored by or on behalf of Stars of Honor. COVID-19 POLICIES, PROTOCOLS AND PROCEDURES Parents will be responsible for taking their childs temperature before camp, and will be asked to confirm that neither they nor their child-camper have a temperature of 100.4 or higher or have otherwise displayed any other symptoms of COVID-19, as listed below at the time of arrival or at any time during the 72 hour period prior to arrival. Parents or campers will not be allowed to attend camp if they or any household members have a fever of 100.4F or above, or display other symptoms of COVID-19, as listed below. Symptoms that will preclude parents and child-campers from camp include fever (over 100.4F), cough, shortness of breath or difficulty breathing, chills, muscle pain, sore throat, or new loss of taste or smell.Social distancing will be maintained in all non-training areas of the facility. Social distancing may or may not occur within the training/activity areas of the facility. In those instances where non social distancing activities or drills are occurring, face masks will be worn by all participants.All campers, staff and parents will be required to wear masks while onsite, subject to exceptions described above for training/activity areas or otherwise designated by Stars of Honor that comply with social distancing and other applicable requirements (e.g., while drinking or eating). Camp staff will adhere to the same health guidelines as described for campersRegular handwashing will be enforced for campers and staff.Campers bring their own equipment including bat, helmet and glove. Catchers should bring their own gear if they have it.Campers will be prohibited from licking their fingers or spitting on the field.Campers must bring their own water bottles. Water coolers will not be available. Campers cannot share cups or water bottles. Campers will not be allowed to use or have cell phones on them during camp hours. The cell phones must be kept in their camp bag and can only be used in the event of emergency.Any deliberate or repeated violation of that policy will result in removal from camp. By registering for any Stars of Honor camp, I acknowledge the contagious nature of Coronavirus/COVID-19 and voluntarily assume the risk that my minor child(ren) and I may be exposed to, or infected by COVID-19 while using the camp facility or participating in any camps/programs hosted or sponsored by or on behalf of Stars of Honor, and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by Coronavirus/COVID-19 at or while using any camp facility, or participating in any camps/programs hosted or sponsored by or on behalf of Stars of Honor may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Stars of Honor, any camp or facility site host or sponsor and any of their respective employees, coaches, volunteers, program participants and their agents, representatives or families (collectively, "Released Parties"). I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my minor child(ren) or myself including, but not limited to, personal injury, disability, death, illness, damage, loss, claim, liability, or expense, of any kind, that I or my minor child(ren) may experience or incur in connection with use of camp facilities, and/or while participating in camps/programs hosted or sponsored by or on behalf of Stars of Honor. On my behalf, and on behalf of my minor child(ren)s, I hereby release, covenant not to sue, discharge, and hold harmless the Released Parties of and from any and all Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Released Parties, whether a Coronavirus/COVID-19 infection occurs before, during, or after participation in any camp/program osted or sponsored by or on behalf of Stars of Honor or the use of any related facilities. Nothing herein shall be construed to waive or alter any other limitations, immunities, rights or requirements available to the Released Parties under applicable law or otherwise. By registering for any Stars of Honor camp, I certify that: (1) I am the Parent/Guardian of the Child participant(s) listed on the applicable registration form or I am an adult participant over 18 years of age; (2) I have fully read and understand the above terms and conditions and they apply to Child participant(s) or myself; (3) I understand that I am waiving important legal rights to recover damages for injury and/or property damage; (4) I agree I have been encouraged to seek the advice of my own attorney prior to agreeing to the foregoing; (5) I have read and voluntarily accepted and agreed to the terms and conditions set forth above; and (6) no oral representations, statements or inducements apart from the foregoing have been made. BY REGISTERING FOR ANY STARS OF HONOR CAMP, YOU ARE GIVING UP YOUR CHILDS RIGHT AND YOUR RIGHT TO RECOVER FROM STARS OF HONOR AND THE OTHER RELEASED PARTIES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. Refund Policy Cancellations, refunds and other similar matters relating to the Stars of Honor, LLC (Stars of Honor, SOH, our, we or us) camp/program referenced in the registration materials and form included or referenced in this website (the Stars of Honor Program) will be subject to the terms, conditions and policies contained herein (collectively referred to as the Refund Policy). Please also review the Stars of Honor Terms of Use and Program Policies (the Terms of Use), Privacy Policy, COVID Policy and any other agreement governing or applicable to the Stars of Honor Program (including any separate waiver or releases applicable thereto) referenced on this website or that you may have with Stars of Honor or any SOH Related Party (as defined in the Terms of Use (collectively, "Other Program Documents"). For the avoidance of doubt, this Refund Policy shall in no way limit or reduce the effect of corresponding concepts set forth in the Terms of Use or any Other Program Documents. Capitalized terms used but not defined herein shall have the meanings set forth in the Terms of Use Cancellation and Refunds Cancellation by Participants. If any participant registered for this the Stars of Honor camp/program needs to cancel for any reason, then notice thereof must be must be provided by or on behalf of the parent or guardian that registered such participant to Stars of Honor via email sent to trevor@starsofhonor.com (a "Cancellation Notice"). The following policies and terms will apply and govern the refunds that will be provided or entitled to receive in respect of any such cancellation. If the Cancellation Notice emailed by you is received by Stars of Honor on or prior to December 31, 2020 (the Cash Refund Cancellation Date), then you will receive a cash refund of an amount equal to the camp tuition/fees previously paid by you less a cancellation fee of $75 and a payment processing fee of $10. Any cash refunds described above will be made within 45 days after the applicable Cancellation Notice is received and processed, and any payments thereof will be made through a credit or refund to the credit card or other payment method/medium used by you to fund the payment of the camp tuition/fees unless a different method is specifically requested by you in the Cancellation Notice received by Stars of Honor; provided that, if any additional processing or other fees associated with a different payment method requested in the Cancellation Notice will be netted against (i.e., applied to reduce) the cash refund you will receive. Note that cash refunds will not be paid or provided if a Cancellation Notice emailed by you is not received by Stars of Honor on or before the Cash Refund Cancellation Date.If a Cancellation Notice emailed by you is received by Stars of Honor after the Cash Refund Cancellation Date, then you will not be entitled to receive a cash refund of any part of the camp tuition/fees previously paid by you; however, if such Cancellation Notice is received by Stars of Honor on or prior to the date on which such camp is scheduled to be held (the Camp Date), then you will be entitled to a voucher worth an amount equal to the camp tuition/fees previously paid by you less a $15 registration fee, which voucher will be valid and permitted to be used for any camp, clinic or other program which is held by Stars of Honor on any date occurring on or before January 31, 2022.No cash refunds or vouchers will be provided if a Cancellation Notice emailed by you is received by Stars of Honor after the Camp Date. Cancellation by Participants. If the Stars of Honor Program is cancelled or postponed by Stars of Honor for any reason (including, among other things, due to inclement weather, a facility closure or by government mandate or directive) and your participation therein has not previously been cancelled by you, then you will receive a voucher worth an amount equal to the camp tuition/fees previously paid by you, which will be valid and permitted to be used for any camp, clinic or other program which is held by Stars of Honor on any date occurring on or before January 31, 2023. Note that cash refunds will not be paid or provided if the Stars of Honor Program is postponed, delayed, cancelled or otherwise changed (including changes to the date or location thereof) by Stars of Honor for any reason. PAYMENT METHODS We accept several methods of electronic payment to accommodate your needs, including a number of major credit cards. You represent and warrant that any credit card or other payment information that you submit to us (including those requested in any Cancellation Notice) is true, accurate and complete, and you agree to immediately notify us if any information is inaccurate. You represent and warrant that you have the legal right to use any credit card(s) or other payment methods used in connection with a transaction. The amount of all camp tuition/fees are stated in U.S. Dollars. When you register for the Stars of Honor Program, you authorize us to charge your credit card or other payment medium or account at the time your registration is submitted/received. You are solely responsible for any and all fees charged to your credit card by the card issuer, bank or financial institution, including, without limitation any credit card membership, overdraft, or over-the-credit-limit fees. Some banks and credit card companies impose fees for international transactions. If you are making a booking from outside of the United States on a U.S. credit card, your bank may convert the payment amount to your local currency and charge you a conversion fee. Without limiting the foregoing, Stars of Honor will not be liable or responsible for any delay or failure by you to receive all or any portion of any cash refund payment made via a credit or refund to or against the credit card, account or other payment method/medium used by you to fund the payment of the camp tuition/fees or in accordance with any other information/instructions specifically requested by you in a Cancellation Notice received by Stars of Honor. REGISTRATION/ORDER CONFIRMATION If you do not receive a submission confirmation and purchase confirmation (in the form of a confirmation page or email) after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm, via email to trevor@starsofhonor.com, whether or not your order has been received. Only you may be aware of any problems that may occur during the purchase process. We will not be responsible for losses (monetary or otherwise) if you assume that an order was placed if you failed to receive confirmation. We do not guarantee availability or participation of or for any Stars of Honor Program until there is confirmation that an order has been processed by and through the applicable Stars of Honor website and that payment in full of the camp tuition/fees has been received by Stars of Honor. BILLING INFORMATION VERIFICATION Orders are subject to credit card approval and will be processed only after a billing address and other billing information has been verified. Occasionally, we receive incorrect billing or credit card account information for an order, which may delay processing and delivery. If we are unable to reach you and or if these issues are not otherwise resolved in a timely manner, we may cancel your registration without further notice. FULL PAYMENT REQUIRED Full payment is required upon checkout to secure your registration for the Stars of Honor Program. We are not obligated to accept any registration or to otherwise allow any participant to attend the Stars of Honor Program, unless and until we receive the full and timely payment of all camp tuition/fees. If we do not receive payment in full at the time of registration, we have the right to cancel/termination/reject your registration for the Stars of Honor Program without any further obligation or liability owed to you. NON-CIRCUMVENTION You agree that you will not attempt to evade, avoid, or circumvent any refund prohibitions in any manner with regard to any Stars of Honor Program(s) or Service(s) you have registered for or purchased. Without limiting the generality of the foregoing, you will not contact us to seek a refund or exchange from us except in the limited circumstances set forth above, and you will not dispute or otherwise seek a chargeback from the company whose credit card you used to pay any camp tuition/fees or to purchase any other Service(s) from Stars of Honor. Should you do so, your registration for, purchase of, or use or access to, any Stars of Honor Program(s) or other Service(s) may be canceled, and we may, in our sole discretion, refuse to honor pending and future registrations and purchases made from all credit card accounts or online accounts on which such chargebacks have been made, and may prohibit all persons in whose name the credit card accounts exist and any person who accesses any associated online account or credit card or who otherwise breaches this provision from using or accessing any Services, including any Stars of Honor website. PROGRAM CHANGES, CANCELLATIONS, ETC.; LIMITATIONS OF LIABILITY You bear all risks of inclement weather or other events, circumstances or conditions affecting the Stars of Honor Program or relate facility (including, among, others, the unavailability of such facility, any mandates or directives from or by any governmental body or facility owner or operator). All dates and times are subject to change by Stars of Honor. All determinations and decisions to postpone, delay, cancel or otherwise modify or change the Stars of Honor Program or the date or location thereof (including those made in relation to weather or any other events, circumstances or conditions described above (or risks associated therewith, whether actual, potential or otherwise) shall be permitted to be made in the sole and absolute discretion of Stars of Honor. STARS OF HONOR WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION COSTS RELATED TO TRAVEL AND LOST PROFITS) ARISING OUT OF OR RELATING TO THIS REFUND POLICY OR THE TRANSACTIONS IT CONTEMPLATES (WHETHER FOR BREACH OF CONTRACT, TORT, NEGLIGENCE, OR OTHER FORM OF ACTION) AND IRRESPECTIVE OF WHETHER YOU OR STARS OF HONOR HAS BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES. IN NO EVENT WILL STARS OF HONORS LIABILITY EXCEED THE PRICE YOU PAID TO STARS OF HONOR FOR THE SPECIFIC STARS OF HONOR PROGRAM GIVING RISE TO AN APPLICABLE CLAIM. No action arising out of or relating to this Refund Policy or the transactions it contemplates may be commenced against Stars of Honor after June 30, 2020. INDEMNIFICATION You hereby agree to indemnify, defend, and hold harmless Stars of Honor from and against any and all claims suits, demands, and causes of action, and any resulting costs and expenses, fines, damages, liabilities, losses, settlements and judgments, including, without limitation, reasonable attorneys fees and legal expenses (collectively, the Claims) that may be asserted by a third party against Stars of Honor that arise out of, result from, or relate to your registration for the Stars of Honor Program or any payment made in respect thereof, enjoyment of any of the rights, benefits, or items related thereto, including, without limitation, attendance or participation at or in any Stars of Honor Program, or use or access of or to any related services, and for all Claims that otherwise arise out of or result from, directly or indirectly, in whole or in part, without limitation, your breach or failure to abide by any part of this Refund Policy. OTHER INDEMNIFICATION OBLIGATIONS, DISCLAIMERS, WAIVER, ETC. The limitations, disclaimers, waivers and indemnification obligations contained in Section 7 and 8 above or elsewhere herein are in addition to and not in limitation of any limitations, disclaimers, waivers or indemnification obligations or similar provisions contained in the Stars of Honor Terms of Use (the "Terms of Use"), any other Program Agreement (as defined in the preamble to the Terms of Use) (including, among others, any separate waiver or release related to the Stars of Honor Program) or any other document, agreement, policy or agreement governing or applicable to the Stars of Honor Program or otherwise delivered or entered into by you with or to Stars of Honor or any other SOH Related Party (as defined in the Terms of Use). EJECTION AND CANCELLATION; NO REDEMPTION VALUE We reserve the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct our personnel deems disorderly, who uses vulgar or abusive language, or who fails to comply with the Stars of Honor Terms of Use or any Program Policies applicable to any Stars of Honor Program. Breach of thereof will terminate your license and right to enter, be present for, or attend any Stars of Honor Program for which you have registered or purchased without refund. GOVERNING LAW AND DISPUTES You agree that the governing law and dispute resolution provisions contained in Section 14 and 15 of the Terms of Use shall apply to this Refund Policy and any disputes relating hereto or arising hereunder.
